Immigration News: Appeals Court Sets Hearing on Executive Actions

Immigration Deferred Action DAPA News:

The Fifth Circuit Court of Appeals has scheduled a court hearing on April 17, regarding the Government's request to stop the Injunction against President Obama's Executive Actions.  

Judge Hanen in Texas issued an Injunction in February, which means that the Government is not allowed implement DAPA while the Injunction is in place.  The Government has asked the Fifth Circuit Court of Appeals to "stay" the Injunction.

If the Fifth Circuit grants the Stay, then the Injunction will be lifted and the Government could then proceed with DAPA and Extended DACA under President Obama's Executive Actions which were announced on November 20, 2014.

At the hearing on April 17, the Court will hear oral arguments from each side. Each side will have one hour each to present its case.  However, the Court will not make a decision that day.  It is unknown when the Court will issue its decision in this historic case, but it could take at least a month.

El Tribunal de Circuito de Apelaciones del Quinto ha programado una audiencia en la corte el 17 de abril, en relación con la solicitud del Gobierno para detener la orden judicial contra acciones ejecutivas del presidente Obama.

Juez Hanen en Texas emitió una orden judicial en febrero, lo que significa que el Gobierno no está autorizado a aplicar DAPA mientras que el Interdicto está en su lugar. El Gobierno ha pedido al Tribunal de Circuito de Apelaciones del Quinto "permanecer" la medida cautelar.

Si el Quinto Circuito otorga la estadía, el Interdicto será levantado y el Gobierno podría entonces proceder con DAPA y DACA extendido debajo de acciones ejecutivas del presidente Obama que se anunció el 20 de noviembre de 2014.

En la audiencia el 17 de abril, la Corte escuchará los argumentos orales de cada lado. Cada lado tendrá una hora cada uno para presentar su caso. Sin embargo, la Corte no tomará una decisión ese día. No se sabe cuando el Tribunal emitirá su decisión en este caso histórico, pero podría tomar por lo menos un mes.
